Frequently Asked Questions:
Asset Tracing and Judgment Enforcement

Under Thai law, a judgment creditor must petition the court for a writ of execution and notify the Legal Execution Department within 10 years of the judgment becoming final. Failure to act within this period results in the loss of the right to enforce the judgment.
OSP LEGAL employs legal methods and investigative resources to identify debtor assets, including real estate, bank accounts, company shares, vehicles, and other income sources, that are eligible for seizure or garnishment.
Most debtor assets, such as houses, land, vehicles, bank deposits, shares, and other movable property, as well as salary within legal limits, may be seized or garnished. However, assets necessary for basic living are exempt from enforcement under Thai law.
After the court issues a writ of execution and we file it with the Legal Execution Department, the execution officer manages the process. This includes sending garnishment notices to banks and employers, scheduling asset seizures, appraising seized property, and arranging public auctions.
There are two main cost categories:
(1) enforcement fees paid to the Legal Execution Department (e.g., seizure fees, publication costs).
(2) asset tracing and legal service fees paid to OSP LEGAL.
The creditor pays these costs upfront and may request court approval to recover enforcement fees from the debtor.
There is no set timeline, as each case depends on factors such as the complexity of asset tracing, asset type, third-party cooperation, the auction process, and any challenges from the debtor. The process may take from a few months to several years.
