Frequently Asked Questions
— Family & Juvenile Cases

The required evidence depends on the grounds for divorce, which are categorized as either general grounds or adultery claims. Key types of evidence include:
1. Basic documents: marriage certificate, national ID card, household registration (or certified translation for foreigners), power of attorney (if applicable).
2. Evidence supporting the “grounds for divorce”: the evidence must correspond to the specific ground being claimed, such as:
• Adultery: photographs, correspondence, witness statements, private investigation reports.
• Physical or mental harm: medical reports, police reports, witness testimony.
• Desertion or abandonment: evidence that the spouse left the marital home without reasonable cause. This may be sufficient on its own, or may require supporting witness testimony.
• Separation for over three years: proof that the parties have lived apart continuously for more than three years, which may be sufficient evidence.
3. Evidence for “adultery claims”:
• Financial evidence: documents relating to jointly held property (e.g., land titles, savings accounts, bank statements).
• Children: documentation regarding the child’s welfare, statements of willingness to provide child support, records of the child’s expenses, and evidence of financial standing.
• Spousal maintenance (for the wife): evidence of the husband’s financial capacity and documentation of living expenses and necessities.

Important: Evidence must be credible and clearly linked to the respondent’s conduct. Consult a lawyer to assess your evidence before proceeding.

You can claim child support through two main methods:

1. By agreement: The most efficient approach is for both parents to negotiate the amount and formalize it in writing, such as in a memorandum of understanding or notarized contract.
2. By court filing: If no agreement is reached or the other party fails to pay, you may file a petition with the Juvenile and Family Court. The process includes:
• The court will first attempt mediation to settle.
• If mediation fails, the court will consider evidence from both parties.
• The court determines the amount based on the financial capacity of both parents and the actual needs of the child.

Note: In child support cases, the court prioritizes mediation. If mediation fails, the case proceeds to a formal hearing. The court’s goal is to find the best solution for the child.

Child legitimation should be registered through mutual consent or court proceedings in two main situations:

1. The parents are not legally married: If the parents were not married at the time of the child’s birth, the father must register child legitimation by mutual consent within one year of the child’s birth. Otherwise, the matter must be resolved through court proceedings.
2. The father’s name is not on the birth certificate: If the father’s name was not recorded at birth, he must register legitimation through the appropriate legal channels. If registration by consent is not completed within the prescribed time, the matter must be resolved through court proceedings. The court will review the evidence and issue an order.

To file an adultery claim in court, you must provide sufficient evidence of an intimate relationship between the defendant and the plaintiff’s spouse. Acceptable evidence includes:

• Photographs or videos: images showing the persons together in a manner beyond normal friendship, or evidence of them being in private together.
• Messages: chat messages (LINE, Messenger), SMS, or emails with content indicating a special or intimate relationship.
• Witness testimony: individuals who have personally witnessed inappropriate behavior, such as staying overnight together or openly displaying affection.
• Travel and accommodation records: evidence showing the parties traveled together, including hotel receipts, booking confirmations, or similar documentation.
• Evidence of financial support: instances of providing money or property to the plaintiff’s spouse that are linked to the relationship.

Important: Evidence must be credible and clearly linked to the respondent. Consult a family lawyer in Bangkok to evaluate your evidence before proceeding.

If your spouse will not sign the divorce registration or consent to a divorce, an administrative divorce cannot proceed because both parties must agree. In this situation, you must file for a contested divorce through the Family Court.

There are several possible approaches:

1. File based on recognized grounds for divorce: Thai law requires specific grounds for divorce. You cannot file solely because you “no longer wish to be married” or due to “irreconcilable differences.” Section 1516 of the Civil and Commercial Code lists acceptable grounds, such as adultery, physical or mental harm, desertion for over one year, imprisonment for over one year, and others.
2. Seek court-supervised mediation or settlement: The court may facilitate mediation. If both parties reach an agreement, the court can issue an order based on the settlement.
3. Submit a request for consent to divorce: The petitioner may formally request the respondent’s consent to a mutual divorce. If the respondent does not object within the required period, the court may grant the divorce.

Thai law does not specify a maximum amount for child support. The amount depends on two main factors:

1. The financial capacity and expenses of the parent, including all necessities for the child, such as food, medical care, clothing, education, and living costs.
2. The financial status of both parents, including income, assets, debts, and overall financial capacity.

As a result, child support amounts vary from case to case. The court determines an amount that ensures the child’s well-being without placing an undue financial burden on the paying parent.

Criminal cases involving children and juveniles are handled differently from adult cases under Thai law. The focus is on protecting the child’s welfare, rehabilitation, and providing opportunities for reform. These cases are processed through the Juvenile and Family Court, which uses specialized procedures:

1. Age Considerations:
• Under 10 years old: The law considers the child incapable of criminal responsibility. No criminal charges are filed, but protective welfare measures may be put in place.
• 10 to under 15 years old: The child is not subject to criminal penalties, but the case enters the juvenile court system. The court may order supervision, behavioral reform, probation, or placement in a training facility.
• 15 to under 18 years old: The child is considered to have committed an offense, but the case is heard in the Juvenile and Family Court. The court may reduce penalties by applying special measures for children, standard sentencing, or a combination of both.

2. Specialized Procedures:
• The Juvenile and Family Court specializes in cases involving minors.
• Special investigations are conducted, including fact-finding about the child, family, environment, and other relevant circumstances to inform the court’s decision.
• The primary objective is rehabilitation, aiming to address and correct the child’s behavior rather than to punish.

In summary, juvenile offenses are processed through the Juvenile and Family Court, which emphasizes protective and rehabilitative measures. The court aims to help minors reintegrate into society and considers their age and maturity when applying alternative measures.
