Frequently Asked Questions:
Document, Translation, and Notary Public Services
What is the difference between notarization by a Notary Public and legalization by the Department of Consular Affairs?
They serve different purposes. A notary public (notarial services attorney in Thailand) certifies the authenticity of signatures, document copies, or personal identity within Thailand. The Department of Consular Affairs authenticates the signature or seal of a government official or notary, enabling documents to be used officially abroad. For international use, a notarized document typically must be legalized by the Department of Consular Affairs afterward (always verify the destination country’s requirements).
After OSP LEGAL translates my documents, do I also need notarization or consular legalization?
It depends on the purpose and receiving authority. For internal use or general reference, additional certification may not be required. However, if the translated document will be submitted to government agencies, courts, embassies, or used abroad, it typically requires notarization of the translator’s signature by a notary public and/or legalization by the Department of Consular Affairs. OSP LEGAL can advise and handle both steps.
What should I prepare for notary public services, and do I need to appear in person? Prepare:
(1) the original document to be notarized
(2) a valid ID card or passport of the relevant party (e.g., the signatory or document owner). An in-person appearance is required for signature witnessing, as the signatory must sign before the notary public. For other notary services, such as a certified true copy, a power of attorney may be used; consult us for specific cases.
Why should I have a lawyer draft or review a contract instead of using a template?
Notarization and legalization serve distinct functions. A notary public in Thailand certifies signatures, copies of documents, or personal identity for use within Thailand. The Department of Consular Affairs authenticates the signature or seal of a government official or notary, allowing documents to be recognized abroad. For international use, a notarized document must usually be legalized by the Department of Consular Affairs. Always confirm the requirements of the destination country.
How does OSP LEGAL determine fees for translation, notarization, and contract drafting services?
Requirements depend on the document’s purpose and the receiving authority. For internal use or general reference, further certification is often unnecessary. However, if the translation will be submitted to government agencies, courts, embassies, or used abroad, notarization of the translator’s signature and/or legalization by the Department of Consular Affairs is typically required. OSP LEGAL can advise you and manage both processes.
How long does each service take — translation, notarization, or contract drafting?
(1) the original document to be notarized
(2) a valid ID card or passport of the relevant party (such as the signatory or document owner). An in-person appearance is required for signature witnessing, as the signatory must sign in front of the notary public. For other services, such as certifying a true copy, a power of attorney may be accepted. Please contact us for guidance on specific cases.
Case Studies & Testimonials
“I almost lost nearly 400,000 baht in condo down payments. OSP LEGAL helped me get every baht back!
When I received a letter canceling my condo purchase agreement and stating that my nearly 400,000-baht down payment would be forfeited, I was shocked and stressed. The developer claimed I had failed to show up for the transfer, even though I never received any notice of the transfer. It felt like I was about to lose a huge sum for nothing, and I had no idea what to do.
Fortunately, I found OSP LEGAL. The team listened carefully and thoroughly reviewed the purchase agreement and the developer’s mailing records. The turning point came when OSP’s attorneys discovered that the developer had sent the transfer notice to an “alternate address” — not the address specified in the contract, and I had never submitted a written change of address. This meant the notice was invalid under the contract.
OSP LEGAL filed a lawsuit on my behalf, arguing this critical error. The court ruled in my favor and ordered the developer to refund the full 392,800 baht plus interest.
I felt an enormous sense of relief and am deeply grateful to the OSP LEGAL team for catching a small but crucial detail that made all the difference. I highly recommend OSP LEGAL to anyone facing a real estate contract dispute. They are thorough, professional, and they truly deliver results.
